1. Eligibility and Access

You must be at least 18 years old to access and use the Platform. By using our Platform, you represent and warrant that you meet this requirement and any other eligibility requirements stated in these Terms. If you are younger than the minimum age requirement, you must have the consent of a parent or guardian to use the Platform.

2. Creating an Account and Third-Party Service Providers

VibrantLife Connect is a SaaS company that partners with various health and wellness providers but does not provide services directly to the user. As a result, you cannot directly create an account with us. Instead, your account will be created through one of our partners who provide health and wellness services.

You agree that you are solely responsible for your relationship with your chosen service provider. We cannot provide you with support on health inquiries, the quality of services, subscription cancellation, or payment refunds. These matters are managed exclusively by the company you have signed up with, and VibrantLife Connect only provides software services to you in partnership with the chosen service provider.

By using our Platform and creating an account through a third-party service provider, you agree that you are solely responsible for your relationship with that provider.

3. User Responsibilities

As a user of the Platform, you are responsible for providing accurate, current, and complete information about yourself during the account creation process and maintaining the accuracy of that information throughout your use of the services. You are also responsible for all activities that occur under your account and for maintaining the confidentiality of your account information and password. You must notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with these responsibilities, including any consequences resulting from providing false or inaccurate information.

4. Services and Platform Content

Our Platform provides a hub for holistic health and wellness resources, connecting users with healthcare and wellness providers, and offering various features to help users manage their health journeys. The services and content on our Platform are not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a physician or other qualified health providers with any questions regarding a medical condition or health-related matter. By using the Platform, you agree that we are not responsible for any health advice, diagnostic or treatment services, or recommendations provided by the healthcare and wellness providers participating in our Platform.

5. Intellectual Property Rights

All content and information on our Platform, including text, graphics, logos, and images, are copyrighted and/or trademarked property owned or licensed by VibrantLife Connect. Any unauthorized use of such materials may violate copyright, trademark, or other laws.

By using the Platform, you agree not to copy, distribute, modify, or create derivative works based upon the Platform, its content, or our intellectual property rights without the express written consent of VibrantLife Connect.

6. User Conduct

You agree to use the Platform only for lawful purposes and in a manner that does not infringe or violate the rights of any other party. You agree not to upload, transmit, or distribute any malicious content, including but not limited to malware, viruses, or content intended to damage or disrupt the functionality of the Platform or any other systems. You also agree not to engage in any activities that interfere with the proper functioning of the Platform or disrupt the use and enjoyment of the Platform by other users.

You further agree not to use the Platform to:

a. Violate any rules, regulations, or applicable laws.
b. Stalk or harass other users or service providers on the Platform.
c. Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying ideas or algorithms of the Platform.
d. Engage in any activity that compromises the security or integrity of the Platform.Violation of these user conduct guidelines may result in the termination or suspension of your access to the Platform.

7. Third-Party Services and Integrations

Our Platform may contain links or integrations to third-party services such as Apple Health and Google Fit. These third-party services are not owned or controlled by VibrantLife Connect. We assume no responsibility or liability for the content, policies, or practices of any third-party services.

Your use of any third-party services is at your own risk and is subject to the terms and conditions of those services. We encourage you to read the terms and privacy policies of any third-party services before using them.

8. Indemnification

You agree to indemnify, defend, and hold harmless VibrantLife Connect and its affiliates, employees, agents, partners, and licensors from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees, resulting from your use of the Platform or violation of these Terms.

9. Disclaimer and Liability

The Platform is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, about the suitability, accuracy, or completeness of the Platform's content or provided services.

In no event shall VibrantLife Connect be liable for any direct, indirect, punitive, incidental, special, or consequential damages resulting from your use or inability to use the Platform, any information obtained through the Platform, or any interactions with healthcare and wellness providers. This limitation of liability applies to the fullest extent permitted by law.

We reserve the right to terminate or suspend your access to the Platform, without prior notice, if you violate any provision of these Terms.

These Terms and any other agreements expressly incorporated by reference constitute the entire agreement between you and VibrantLife Connect with respect to your use of our Platform and supersede all prior or contemporaneous communications and proposals, whether oral, written, or electronic, between you and VibrantLife Connect.
